Controversy

On 27 June 2023, he was arrested by the Enforcement Directorate (ED) from his office in Delhi in connection with a money laundering case. The arrest followed his summons by the ED three days prior. Many First Information Reports (FIRs) had been registered against the company and its directors in Uttar Pradesh, Delhi, and Haryana. The allegations in these FIRs accused the company of collecting money from homebuyers but failing to deliver the promised flats. As per investigations, it was revealed that the Supertech Group received funds from homebuyers and loans from banks for constructing apartments. However, it is alleged that these funds were misused to purchase land instead. The acquired land was then utilized as collateral to repay the bank loans. The ED’s probe discovered that the Supertech Group defaulted on payments to banks and financial institutions, resulting in loans worth Rs. 1,500 crores turning into non-performing assets (NPAs). Furthermore, on 12 April 2023, the ED seized properties worth Rs. 40 crores, including 25 land parcels and buildings in Uttarakhand, as well as the Meerut Mall in Meerut, Uttar Pradesh, belonging to Supertech and its directors. During his court appearance on 28 June 2023, the ED alleged that he diverted Rs. 638 crores collected from homebuyers and obtained through bank loans. Instead of using these funds to complete ongoing projects in Noida, it is claimed that the money was used to purchase properties in Gurugram at inflated prices. Additionally, he allegedly spent Rs. 154 crore to acquire ASP Sarin and Rs. 39 crore to purchase Palash Building Solutions. The ED further stated that Rs. 444 crores were used to buy a company called Sarv Realtors Private Limited in 2013-14. The ED requested 14-day custody of Arora to conduct further investigation into these allegations. [3]Hindustan Times

  • In March 2022, his company faced financial insolvency and was officially declared insolvent by the National Company Law Tribunal (NCLT). The company had accumulated debts amounting to approximately Rs. 432 crores.
  • In August 2022, he experienced great distress when the Twin Towers located at the ‘Supertech Emerald Court’ housing society in Sector 93A, Noida, were demolished. In an interview, he talked about this and said,

As per the UP Apartment Act, 1975 and UP Apartment Act, 2010, a developer goes to an authority to take approval. In terms of violation of the Act, we didn’t violate any of them. When these plans were getting passed, the Apartment Act was not adopted by the Noida Authority. And it was not just for our project, it was for all approvals in the area. Between 2010 and 2014, no one was taking consent on the Apartment Act. There were no special favours given to us. Whatever everyone else was getting, we also got the same.”
