She was booked under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, and Sections 279 (rash driving), 337 (hurting any person by acting rashly or negligently as to endanger human life) and 427 (commits mischief and thereby causes loss or damage) of the Indian Penal Code. On 7 May 2023, the duty magistrate ordered the superintendent of the Central Jail Ludhiana to release her after signing the bail bonds. In a statement by the Assistant Commissioner of Police of Ludhiana, Rajesh Sharma she was released from jail on 7 May. After her release, her organization, Times Now Navbharat stated that Kishore, cameraman Mrityunjay and a driver were arrested by the Ludhiana Police on charges of rash driving and insulting Dalits. The organization also claimed that she was arrested by male police personnel in the car and was denied legal and telephone access and was arrested post-sunset. According to the channel, they were invited to cover an AAP political programme hosted by Delhi Chief Minister Arvind Kejriwal and Punjab CM Bhagwat Mann in Ludhiana. They claimed that the group of women were “motivated AAP workers”. On 10 May 2023, the High Court bench of Justice A G Masih granted her bail. The AAP government denied the allegations and said that there was no political motive behind the registration of the police case against her. [2]The Indian Express
Facts/Trivia
- In May 2023, when she was arrested by the Punjab Police for allegedly hitting a woman with her car and passing derogatory comments on her, the action taken by police was condemned by a lot of journalists. In a statement by the Editors Guild, the FIR registered against her at a Ludhiana police station “appears excessive and with undue haste.”
- AAP leader Atishi commented on the incident and said that no one was above the law and police and the matter should be left in the hands of the court.
- The Chandigarh Press Club also released a statement about the incident and said that when she was arrested there was no female constable and she was not allowed to inform about it to her family. In the statement, it further said,
If a person is hit by a car, under which law the passengers have been booked? How would one know the caste of the complainant to use derogatory language against their caste? Who among the three used such language to be specific?”
- On 10 May 2023, she was granted bail. After coming out of jail, she talked about her experience in jail and said that she was asked to use the washroom with the door open. In an interview, she talked about this and said,
I was not feeling well, so I ate the food [they gave]. The driver and cameraperson also ate a little. I was having a lot of water as I was feeling nervous. When I went to the washroom, 2-3 female constables accompanied me. There was no electricity or water at the police station [I was kept in]. I was allowed to use the washroom at the hospital where there were blood-soaked clothes. I felt like I would vomit. I saw dead bodies in the hospital late at night. If I think about it, I again feel the same.”
